Participant Agreement, Assumption of Risk, Release of Liability & Studio Policies

1. Acknowledgment of Studio Activities

I understand that Art Matters Kids Studio ("Studio") provides a creative environment where children may independently choose and participate in self-directed arts and crafts activities using materials, tools, supplies, furniture, and equipment provided by the Studio.

I understand that the Studio is not a licensed childcare facility, not a daycare, and does not provide supervision of children.

2. Parent/Guardian Supervision Requirement

I understand and agree that:

• A parent or legal guardian must remain inside the Studio and actively supervise their child(ren) at all times.
• I am solely responsible for the supervision, conduct, safety, and behavior of my child(ren).
• Studio staff are present only to maintain the facility, answer questions, replenish supplies, and provide general assistance regarding materials.
• Studio employees are not responsible for supervising, disciplining, or monitoring children.
• I will not leave my child unattended for any reason.

Failure to supervise my child may result in removal from the Studio without refund.

3. Assumption of Risk

I understand that participation in art activities involves inherent risks, including but not limited to:

• Cuts, scrapes, splinters, or punctures
• Use of scissors and other age-appropriate crafting tools
• Contact with paints, glue, clay, markers, inks, and other art materials
• Slips, trips, or falls
• Allergic reactions or skin irritation
• Accidental damage caused by other participants
• Choking hazards associated with small craft materials for young children

I voluntarily assume all risks, known and unknown, associated with participation by myself and my child(ren).

4. Medical Conditions & Allergies

I acknowledge that it is my responsibility to inform Studio staff of any significant allergies or medical conditions before participating.

I understand that art supplies may contain materials including, but not limited to:

• Latex
• Acrylics
• Paint pigments
• Adhesives
• Clay products
• Glitter
• Wood products
• Fabrics
• Paper fibers

The Studio cannot guarantee an allergen-free environment.

5. Release of Liability

To the fullest extent permitted by law, I, on behalf of myself, my child(ren), my heirs, representatives, and assigns, release and forever discharge the Studio, its owners, officers, members, managers, employees, volunteers, contractors, agents, successors, and assigns from any and all liability, claims, demands, causes of action, damages, losses, costs, or expenses arising out of or relating to participation in Studio activities or use of Studio facilities, except where prohibited by law or resulting from the Studio's gross negligence or willful misconduct.

This release includes claims arising from ordinary negligence.

6. Property Damage

I accept responsibility for any intentional or negligent damage caused by myself or my child(ren) to Studio property, equipment, furniture, fixtures, or materials beyond ordinary wear and tear.

I agree to reimburse the Studio for repair or replacement costs when appropriate.

7. Personal Property

The Studio is not responsible for lost, stolen, or damaged personal belongings brought onto the premises.

8. Messy Clothing & Personal Items

I understand that paints, glue, clay, glitter, inks, and other materials may permanently stain clothing or personal property. I release the Studio from claims relating to such damage.

9. Illness Policy

I agree that neither I nor my child(ren) will visit the Studio if experiencing symptoms of a contagious illness including fever, vomiting, diarrhea, or other symptoms that may place others at risk.

10. Emergency Medical Care

In the event of a medical emergency, I authorize Studio staff to contact emergency medical services (911).

I understand that Studio staff are not required to provide medical treatment.

I accept full responsibility for any medical expenses incurred.

11. Rules of Conduct

I agree that my child(ren) will:

• Treat other guests respectfully.
• Use materials appropriately.
• Follow posted Studio rules.
• Use only age-appropriate equipment.
• Avoid running, roughhousing, or unsafe behavior.
• Follow reasonable instructions from Studio staff regarding safety.

The Studio reserves the right to remove any participant whose behavior creates an unsafe or disruptive environment.

12. Memberships & Daily Passes

I understand that:

• Daily passes and memberships provide access only during posted business hours.
• Memberships are non-transferable unless otherwise stated.
• Studio policies regarding cancellations, billing, renewals, and refunds are governed by the membership agreement or posted policies.

13. Photography & Media

I acknowledge that I have separately reviewed the Studio's Media Release and Consent Agreement regarding photography and video recording.

My decision regarding media consent does not affect the validity of this liability waiver.

14. Governing Law

This Agreement shall be governed by the laws of the state in which the Studio operates.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Acknowledgment

I certify that:

• I am at least 18 years of age.
• I am the parent or legal guardian of the minor child(ren) listed above.
• I have carefully read this Agreement.
• I understand its contents.
• I understand that I am giving up certain legal rights.
• I voluntarily agree to all terms.

16. Continuing Effect

This Agreement applies to all future visits under a daily pass, membership, party, event, or other Studio program until replaced or revoked in writing and acknowledged by the Studio. I agree to notify the Studio of any material changes affecting my authority to sign on behalf of my child(ren).
